Phase 1 for retail trade and assimilated services is developed by Order SND/399/2020 of 9 May. The experts of our Labour Consulting Department summarize the applicable measures.

With effect from May 11, several territorial units enter Phase 1.
Application of Phase 1 for retail trade and assimilated services
The relief measures are extended over those established in Phase 0, for the territorial units entering Phase 1.
Free movement is authorized, restricted to the province where you reside. Without prejudice to justified movements to another part of the national territory for health, work, professional reasons, etc.
Meetings of up to a maximum of ten people may be held. A minimum safety distance of 2m must be maintained or alternative measures of physical protection, hand hygiene and respiratory etiquette must be established. This limit does not apply to live-in persons.
- Sharing of private vehicles is also allowed with limitations.
- The celebration of vigils and burials with a maximum limit of fifteen people in open spaces and ten people in closed spaces.
- And the celebration and attendance at places of worship as long as they do not exceed one third of their capacity.
In any case, the general measures of hygiene and physical distance established by the health authorities must be complied with.
Activities
Retail shops of less than 400 m2 and similar services may be reopened. Terraces (hotels and restaurants), hotels, educational centres, libraries, museums, etc.
Rules on hygiene and prevention common to all activities are established. Without prejudice to having to comply with those others specific to each activity.
Peculiarities in the activity of retail trade and the provision of assimilated services
They may be reopened to the public provided that they have a useful exhibition and sales area of 400 m2 or less. With the exception of those located inside parks or shopping centres without direct and independent access from the outside.
Provided that they meet all the following requirements:
- That the total capacity of the commercial premises is reduced to 30%. In the case of establishments distributed over several floors, the presence of customers on each floor must be in the same proportion.
- A minimum distance of 2m between customers must always be guaranteed. In commercial premises where it is not possible to maintain such a distance, only one customer may remain inside the premises.
- That a service schedule is established with priority service for those over 65 years of age.
- That they additionally comply with the measures set out in this chapter.
They may be reopened to the public, using the previous appointment:
- car dealerships
- the vehicle inspection stations
- garden centres and plant nurseries whatever their useful exhibition and sales area.
In addition
They may be reopened to the public by state-owned public games concessionaires. With the exception of those located inside shopping centres or commercial parks, without direct and independent access from the outside.
All establishments and premises that may reopen to the public may establish, where appropriate, on-premises collection systems for products purchased by telephone or Internet. This is provided that they guarantee a staggered collection that avoids crowding inside the premises or access to them. A preferential home delivery system may also be set up for specific groups.
When the corresponding local councils so decide, and this decision must be communicated to the competent health body of the Autonomous Community, the markets that carry out their activity in the open air (flea markets) may reopen. In any case, a limit of 25% of the usual or authorised stalls will be guaranteed. And an influx of less than a third of the usual capacity can proceed to increase the area available for the exercise of this activity so that there is an effect equivalent to that limitation.
Hygiene measures required of establishments and premises open to the public
These are:
- Carry out at least twice a day, a cleaning and disinfection of the facilities with special attention to the most frequent contact surfaces. Such as door handles, counters, furniture, handrails, dispensing machines, floors, telephones, hangers, trolleys and baskets, taps, and other elements of similar characteristics. According to the following guidelines:
- One of the cleanings must be carried out at the end of the day.
- The general cleaning and disinfection instructions will be applicable.
- For this cleaning, a break may be taken during the day, preferably at midday, to carry out maintenance, cleaning and replacement tasks. These times of closure for cleaning shall be duly communicated to the consumer by means of visible signs. Or with messages on the loudspeaker.
- In addition, cleaning and disinfection of the workstations shall be carried out at each change of shift. Special attention will be given to counters and tables or other elements of the market stalls. Screens if necessary, keyboards, payment terminals, touch screens, work tools and other elements susceptible to manipulation. Paying special attention to those used by more than one worker. When more than one worker is to remain in the establishment or premises to attend to the public, cleaning measures shall be extended not only to the commercial area but also, where appropriate, to workers’ private areas. Such as changing rooms, lockers, toilets, kitchens and rest areas.
- The operation and cleaning of toilets, taps and doorknobs of toilets in retail shops and premises shall be checked at least once a day.
Important
- In the case of vending machines, self-service laundries and similar activities. The owner of these machines must ensure compliance with the appropriate hygiene and disinfection measures for both the machines and the premises. They must also inform users of their correct use by installing informative signs.
- Customers shall not use the toilets in commercial establishments. Unless it is strictly necessary. In the latter case, the toilets, taps and door handles shall be cleaned immediately.
Measures of hygiene and/or prevention for the personnel working in the establishments and premises that open to the public.
The distance between the vendor or service provider and the customer during the entire customer service process shall be at least 1m when protective or barrier elements are in place. Or approximately 2m without these elements. Likewise, the distance between stalls in open-air markets or non-sedentary sales (flea markets) on public roads and pedestrians will be 2m at all times.
In the case of services that do not allow the maintenance of the interpersonal safety distance. As in the case of hairdressers, beauty or physiotherapy centres, the appropriate protective equipment must be used to ensure the protection of both the worker and the client. In all cases, the 2m distance between one client and another must be maintained.
Measures relating to customer hygiene inside establishments and premises And in open-air markets or non-sedentary street sales.
- The time spent in the establishments and premises will be the time strictly necessary for customers to make their purchases. Or to receive the service.
- The establishments and premises, as well as the open-air markets or non-sedentary sales in the public thoroughfare (markets), must clearly indicate the interpersonal safety distance of 2m between customers. With marks on the floor, or by the use of beacons, posters and signs.
- For those cases in which it is possible to provide individualized attention to more than one customer at the same time. That cannot be done simultaneously by the same employee.
- The establishments and premises must make available to the public dispensers of hydroalcoholic gels or disinfectants with virucidal activity authorized and registered by the Ministry of Health. In any case at the entrance of the premises, which must always be in a condition for use. It is recommended that these dispensers are also available in the vicinity of open-air markets or for non-sedentary sales on the public highway.
- In shops and commercial premises, as well as in open-air markets or non-sedentary street markets, which have self-service areas. The service must be provided by a worker in the establishment or market, in order to avoid direct handling of the products by the customers.
- Test products not intended for sale may not be made available to customers. Such as cosmetics, perfumes and similar products involving direct handling by successive customers.
- In the establishments of the commercial textile sector, and of clothing arrangements and similar, the testers must be used by only one person, after their use they must be cleaned and disinfected.
Important
In the event that a customer tries on a garment that he does not subsequently purchase, the owner of the establishment will implement measures to have the garment sanitized before it is provided to other customers. This measure shall also apply to the return of garments by customers.
Capacity measures for establishments and premises open to the public
- The establishments and premises must expose to the public the maximum capacity of each premises. And ensure that this capacity, as well as the interpersonal safety distance of 2m is respected inside.
- To this end, the establishments and premises must establish systems that allow the counting and control of the capacity. So that this is not exceeded at any time, and that it must include the workers themselves.
- The organization of the movement of persons and the distribution of spaces must be modified, when necessary, with the objective of guaranteeing the possibility of maintaining the interpersonal safety distances required at all times by the Ministry of Health.
- Preferably, whenever a premises has two or more doors. Differentiated use may be established for entry and exit, thereby reducing the risk of congestion.
- In establishments and commercial premises that have their own car parks for employees and customers, when access to the facilities, ticket and employee card readers cannot be done automatically without contact, this will be replaced by continuous manual control by security personnel, to better follow up on seating regulations. These personnel will also supervise compliance with the rules for staggered arrival and departure of employees to and from their work stations, according to the shifts established by the center.
Where appropriate, and unless strict security reasons recommend otherwise, the doors along the route between the car park and the access to the store or the employees’ changing rooms will remain open to prevent tampering with the opening mechanisms.
Important
No commercial actions may be announced or carried out which may lead to crowding. Both within the commercial establishment and in its vicinity. Unless there is a subsequent rectification.
This restriction will not affect sales on sale or sales on offer or promotion that are made through the website.
