New measures on housing leases in 2023 are approved. Last December 28th, RDL 20/2022 was published, extending the social protection measures on housing leases.
Below we explain its content.
New measures on housing leases in 2023
Specifically we are going to refer to three measures in particular.
Limitation of the annual update of the rent
The rents for housing leases that must be updated in 2023, will have a maximum increase of 2%. Therefore, this measure limiting the rent increase in force since March of this year is maintained.
Extraordinary extension of rental contracts for principal residences
Lease contracts for habitual residence whose expiration date is between the date of entry into force of the RDL and June 30, 2023 may be extended by the lessee. For a maximum period of six months, which must be requested to the lessor. The lessor will be obliged to accept the extension.
During the extension period the agreed contractual conditions are maintained.
Suspension of evictions and throws
In all lawsuits on claims for rent or other amounts owed by the tenant. Or also on the expiration of the term of the lease, in order to recover possession of the property from the owner, the tenant may request the extraordinary suspension of the proceedings. This can be applied in any of its phases, including those of eviction or launching, for being in a situation of economic vulnerability.
The suspension will be maintained until June 30, 2023.
