On 6 April 2018, the Spanish Council of Ministers approved new measures to intensify the control of unjustified temporary employment contracts, of part-time employment contracts, as well as of training contracts. Accordingly, the 2018-2020 Strategic Plan of the Labour and Social Security Inspectorate is to be implemented, that shall designate the Labour Inspectorate as the public institution for guaranteeing the quality of employment. The document has already been transposed into applicable regulations by way of Royal Decree 192/2018, of 6 April, published in the O.S.G. of 7 April.
The aforementioned Strategic Plan sets out the functions that shall be exercised by the Labour and Social Security Inspectorate for intensifying the control activities. The foregoing functions include the increase of human resources up to a sufficient number, highly qualified and specialised in specific aspects. The enhancement of the human resources constitutes a prolongation of the measures implemented as from the approval of the 2012 Fraud Prevention Plan.
The controls shall be intensified in particular in relation to training, part-time and unjustified temporary contracts.
Royal Decree 192/2018 implements the Labour and Social Security Inspectorate System Act, that was approved during the previous.
The basis for the new organisational model of the Labour Inspectorate established pursuant to the foregoing Act was the transformation of the current Directorate-General of the Labour and Social Security Inspectorate of the Ministry of Employment and Social Security into a newly created and autonomous body, the State Labour and Social Security Inspectorate Body, the Statutes of which have been approved by said Royal Decree. Said State Body shall also be responsible for the deployment and the complete execution and implementation of the 2018-2020 Strategic Plan. The State Body shall comprise all of the staff that currently provide services at the Directorate-General of the Labour and Social Security Inspectorate, namely approximately 3,000 public civil servants that include inspectors, deputy inspectors and support staff. Moreover, the State Body shall be deployed in the 17 Autonomous Regions, throughout all of the Spanish provinces, and in the cities of Ceuta and Melilla.
