New extension of the suspension of evictions in situations of vulnerability. Last February 22, Royal Decree-Law 2/2022 was approved, by virtue of which certain extraordinary measures on housing rentals are extended until September 30. Measures derived from the state of alarm decreed by the COVID-19. Thus, what will probably be the last extension of measures is approved. Before the entry into force of the future Housing Law.
New extension of the suspension of evictions in situations of vulnerability
According to what has been published, the following measures are extended.
Firstly, the extraordinary suspension of eviction proceedings is extended until September 30, 2022. And of evictions for vulnerable households.
In addition, the possibility of requesting the procedure for obtaining compensation for landlords or owners of the affected homes is extended until October 31, 2022.
However, they are not extended:
- The possibility for the lessee to request the extraordinary extension of the lease term, for a maximum period of six months. In the case of housing leases that terminate due to the expiration of their term.
- The possibility of the tenant who is in a situation of economic vulnerability, to request the temporary and extraordinary deferral in the payment of the rent. Or the total or partial cancellation of the same.
When is a situation of economic vulnerability considered to exist?
This occurs in the following two cases.
First, that the person who is obliged to pay the rent becomes unemployed, or in an ERTE. Or, that he/she has reduced his/her working hours due to caregiving, or other similar circumstances, which entail a substantial loss of income.
Also, that the rent, plus basic expenses and supplies, is greater than or equal to 35% of the net income. Those received by all the members of the family unit.
On the contrary, it will not be understood that the assumptions of economic vulnerability concur when the tenant or person that forms part of the family unit that inhabits the housing in question, is the owner or usufructuary of any housing in Spain.
