Last April, we reported that the Labour and Social Security Inspectorate (ITSS) had strengthened the team of officials (Sub-inspectors and Inspectors) in order to cover the increase in actions planned for 2018. This increase was the start of the ITSS Strategic Plan for 2018, 2019 and 2020, approved by the Council of Ministers on 6 April and published in the BOE on 19 April 2018.
Within the framework of the ITSS Strategic Plan, the Council of Ministers approved the Master Plan for Decent Work 2018-2020 on 27 July 2018.
The plan aims to promote employment and enterprises, guarantee rights at work, extend social protection and promote social dialogue in line with the strategic objectives of the International Labour Organization. The plan also aims to strengthen the guarantee of present and future sustainability of social security and social benefits.
This Plan includes 75 operational measures against contract abuse and fraud. They shall monitor temporary and part-time contracts. Excessive working hours and overtime hours not paid or compensated for by rest periods. And unpaid wages in general.
It will also promote equality, the regularisation of false self-employed and false trainees.
The development of the Plan contemplates two main actions:
- Against fraud in temporary contracts
- Against the irregular use of part-time recruitment
Six-monthly monitoring of compliance with the measures is planned and an evaluation of the actions carried out for January 2019. And of the Master Plan as a whole is planned in 2020.
Important note
The ITSS is sending personalized communications to companies informing them of any possible non-compliance detected.
It is important that these communications be analyzed by experts in the field. In order to take the necessary decisions to prevent the ITSS from intervening ex officio.
